The first penal code was introduced by Emperor Charles V. Its content reflects the "Constitutio Criminalis Carolina" and it marked the transition from medieval to modern times. Although witch crimes and torture were still accepted, the "Carolina" encouraged "fair" sentences. It only had restricted validity, but it still formed the basis for the German penal code. |
